The customer declares to have read and accepted the terms and conditions of these general and special sales conditions.

All-risk sports travel insurance with hospitalization and medical repatriation.
TERMS AND CONDITIONS OF SALE
1.DEFINITIONS
The “Tenant” refers to the lessee named in the Rental Contract.
The “Lessor” refers to the company “Saba tours” whose corporate name appears on the Rental Contract.
2.PURPOSE
The “Hirer” leases to the “lessee” in return for payment, the vehicle as described in the Lease Agreement.
This lease is governed by the present General Terms and Conditions of Sale attached to the Lease Agreement. The authorized “lessee” is responsible for ensuring full compliance with these conditions and acknowledges acceptance of the terms prior to signing the Lease Agreement.
3.COMMITMENTS OF THE "LESSOR
3.1 Vehicle condition
The “Rental Firm” undertakes to provide the “Hirer” with the vehicle in good working order, maintained in accordance with the manufacturer’s instructions.
The “Rental Firm” declares that the vehicle is in conformity with its intended use and that it is free of any apparent damage, except for those mentioned on the description of the rented vehicle which is given to the “Hirer” at the beginning of the rental period. It is the “Renter’s” responsibility to have any apparent defects that are not mentioned in the description of the vehicle noted before departure. In the absence of a contradictory report, the vehicle is deemed to be free of any apparent damage, unless there is proof to the contrary.
The “Hirer” declines all responsibility for any delays caused by breakdowns or necessary repairs to the transport vehicle during the rental period. The “Hirer” may not claim damages for any interruption, incident or accident attributable to the condition of the vehicle or tires during the rental period. In the event of breakdown of the rented Vehicle not attributable to the “Renter”, and if the vehicle is immobilized for more than one day, the “Renter” will endeavor to replace it with any other motorcycle-type vehicle, subject to availability at the time.
3.2. Insurance
The “Renter” has taken out third-party liability insurance for its Vehicles with RMA (Royal Marocaine d’Assurance) in Kenitra. As a result, only damage caused by the Vehicle to third parties is covered. The “Hirer” accepts no liability to the “Hirer” for any claims, damages and/or expenses arising from personal injury, accidents, death, or loss of personal property, delays, missed connections, adverse weather conditions, strikes, acts of terrorism, wars or any other causes unforeseeable at the time of departure or chosen activity, including, the “Hirer’s” inability to obtain the required travel documents (passport, visas, etc.) to travel within Morocco.
3.3. Luggage
If requested, luggage is transported free of charge at each stage, at the risk of the “Hirer” if the assistance vehicle option is taken, otherwise each “Hirer” is responsible for his or her own luggage.
3.4. Weather conditions
The “Hirer” cannot be held responsible for adverse weather conditions, which are not subject to reimbursement. The “Hirer” may cancel or modify the itinerary depending on weather conditions, to facilitate travel or for safety reasons.
4. OBLIGATIONS OF THE "LESSEE
From the moment the Vehicle is made available, the “Hirer” is solely responsible for the Vehicle and the consequences that may result from its use. The Vehicle may only be driven by the person previously and expressly approved by the “Hirer” and identified in the Rental Contract.
4.1. Driver's license
The “Hirer” must present a driving license that corresponds to the rented Vehicle, that has been valid for more than 2 years and that is at least 30 years old (type license: A for the Euro zone) without restriction from his or her country of residence.
4.2. Health / Fitness
The “Renter” confirms that he/she is fit for off-road motorcycling. He/she is strongly advised to consult his/her usual doctor before departure to inform him/her of his/her forthcoming intention to rent the Vehicle in Morocco and to follow his/her instructions, if any.
The “Hirer” must complete a certificate stating that he/she has no medical contraindications to the practice of physical activities and sports, and if this proves to be inaccurate, releases the “Hirer” from any liability for medical incidents occurring during the rental period. When signing the Rental Contract, the “Hirer” is requested to inform the “Hirer” of any medical problem that may affect the smooth running of the rental. Should the “Renter” become ill during the rental period, or be unable to continue the trip for medical reasons, the “Hirer” will arrange for a medical consultation or, if necessary, repatriation.
4.3. Vehicle use / Behaviour
The “Renter” shall not allow any other person to drive the Vehicle, which is the subject of this contract, and shall use the Vehicle in strict compliance with the standards and recommendations of the Manufacturer and the “Renter”, scrupulously following the recommendations of the latter, who reserves the right to terminate the rental immediately and by operation of law without being required to provide justification or compensation, in the event that the “Hirer” fails to comply with any of the obligations essential to the use of the Vehicle, safety and environmental instructions, or disrupts the smooth running of the rental by infringing the rights or well-being of the other members of the group. In the event of exclusion, the “Renter” will be responsible for all costs incurred as a result of his or her conduct, including additional costs for accommodation, food and return transport.
The “Renter” undertakes to use the Vehicle responsibly, to comply with safety instructions throughout the rental period, in particular to: always wear the appropriate safety equipment : helmet, jacket, boots, gloves …, to respect the Highway Code and speed limits in all circumstances, not to use the Vehicle at night due to reduced visibility, to respect safety distances, particularly when overtaking, without any spirit of competition or racing, not to drive under the influence of alcohol or drugs or any other substance affecting his/her consciousness or driving ability.
The “Renter” also undertakes to respect the environment, the landscape, the fauna, the flora and the people encountered throughout the journey, to exercise discretion and to reduce speed in the vicinity of public places or dwellings, when encountering herds, people on foot or any other vehicle.
SABA TOURS is not responsible for any loss, theft, personal injury or material damage that may occur during the trip, and the participant agrees to waive any civil or criminal recourse against SABA TOURS.
Under no circumstances can SABA TOURS be held responsible for traffic accidents or incidents due to external factors (climatic incidents, poor road conditions, stray animals, natural disasters).
SABA TOURS will not be held responsible for the non-payment of extras by participants, for any damage or deterioration they may cause during the trip, or for any fines for which participants may be liable, all of which are the exclusive responsibility of the participant.
4.4, Insurance
The “Hirer” undertakes to do everything in his power to ensure safety, but activities in the natural environment involve risks and uncertainties. For this reason, the “Hirer” must take out personal “All Risks” sports travel insurance with medical repatriation (for example and without limitation, with https://www.eu-rop-assistance.fr/, www.worldnomads.com, https://www.allianz-voyage.fr/, CAA, Croix bleue etc…). This insurance must cover, in particular, cancellation and/or interruption of the tour, personal accidents, ancillary health costs (local medical care, hospitalization), repatriation, loss of personal property, etc. The “Hirer” will provide the “Rental Firm” with a copy of the contract, detailing the name of the insurance company, the number and validity of the insurance policy, and the insurer’s contact details.
4.5, All-terrain equipment
The “Hirer” must bring his or her personal belongings for appropriate riding on roads and tracks, according to the itinerary defined by the “Renter”, i.e. at least: full-face off-road helmet, protective goggles, enduro gloves and boots, protective jacket with back protector, elbow pads and shoulder protection, pants with knee pads, 3-liter Camelbak-type backpack, rain protection.
RENTAL TOURS
The “Hirer” must maintain a safe distance from members of the group and take all necessary precautions in the event of overtaking in order to avoid the projection of dust and stones towards neighbouring persons or vehicles.
The “Hirer” undertakes to follow the “Owner’s” recommendations and instructions during the daily briefings and throughout the rental period.
5. PICKING UP / RETURNING THE VEHICLE
Throughout the rental period, the Vehicle itself and its proper use are under the responsibility and supervision of the “Renter”.
The “Renter” is responsible for any damage to the rented Vehicle. A report on the condition of the vehicle is drawn up between the “Renter” and the “Hirer” at the time of pick-up and return. The Vehicle is delivered in good working order (engine, transmission, bodywork, tires, etc.) and must be returned in the same condition as when picked up, except for normal wear and tear due to the use of the Vehicle. No claims will be accepted after departure. Any damage noted on the return report will be charged to the “Hirer”, as well as the cost of repair and immobilization, in accordance with the schedule of charges for damage appended to the Rental Contract or a quotation from a dealer of the Vehicle’s make. These costs will be added to the cost of the rental.
6. SECURITY DEPOSIT
It is intended to cover any loss suffered by the “Hirer” as a result of an incident for which the “Hirer” is liable. The schedule of charges for damages is attached to the Rental Contract. The “Renter” declares that he has read it and accepts its terms and conditions without reservation. The amount of the security deposit is shown on the Rental Contract. All or part of the security deposit will be retained in the event of damage to the Vehicle and/or its accessories, in accordance with the damage billing schedule. The deposit will be returned in full at the end of the rental period if no damage has been caused to the Vehicle. The same provisions apply to rented accessories and equipment (boots, helmets, gloves, overalls, etc.).
The deposit depends on the motorcycle you rent, and is payable in cash when you take possession of the motorcycle. Our aim is not to take your deposit, but rather to make you responsible for the use of your equipment.

7. TERMS OF PAYMENT
On reservation, deposit of 0% of the total rental price,
Before taking possession of the Vehicle, the balance of the total rental price and security deposit.
8. CANCELLATION POLICY
As there is no booking deposit, the risk of cancellation is entirely ours.
Please note that if you book and do not show up on the day of pick-up or cancel less than 90 days before the rental date without a valid reason, you will be barred from booking with us in the future.
9. MISCELLANEOUS
The “Rental Firm” with the authorization of the “Tenant” reserves the right to film or photograph the “Tenant” within the strict framework of the rental and to use the footage for promotional purposes, in the “Rental Firm’s” brochures or website and for any other commercial purpose.
10. JURISDICTION CLAUSE
Any dispute or controversy of any nature whatsoever relating hereto, which is not resolved amicably, shall be subject to the jurisdiction of the city of Kenitra (Morocco) to the exclusion of any other jurisdiction and shall be resolved in accordance with Moroccan law. The nullity of all or part of a clause of the Rental Contract shall not affect the validity of the other clauses.
TOURIST MOTORCYCLE RENTAL CONTRACT

Kenitra and represented by Aziz Tabroura, hereinafter referred to as “SABA TOURS SARL à Associé Unique”,
and the customer
Object
The purpose of this contract is to rent a motorcycle for tourist purposes in Morocco, on a daily basis or as part of a Morocco Adventures package marketed by “SABA TOURS”.
The Vehicle will be taken in hand by the “Hirer” and returned by him/herself according to the date/place/mileage agreed on the day the contract is signed.
SCHEDULED RETURN
If the agreed date and time are exceeded, an additional day’s rental will be charged automatically every 24 hours.
Commitments of the parties
“SABA TOURS SARL à Associé Unique” undertakes to provide the “Hirer” with the following services: a vehicle in good working order, with a full tank of fuel. Third-party insurance for the vehicle (Civil Liability), mechanical and logistical assistance (only as part of a package).
The “Hirer” undertakes to “SABA TOURS” to:
– Pay the full price of the agreed rental before picking up the vehicle,
– Take out travel/repatriation and medical insurance, and return the vehicle with a full tank of fuel,
– Accept the General Terms and Conditions of Sale attached to this contract.
